DMCA Policy

Cream Of Broccoli Soup respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which can be found on the U.S. Copyright Office website, Cream Of Broccoli Soup will respond expeditiously to claims of copyright infringement committed using the Cream Of Broccoli Soup service or website if such claims are reported to our Designated Copyright Agent identified in the sample notice below.

Filing a Notice of Copyright Infringement (for Copyright Holders)

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Cream Of Broccoli Soup service by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

  1. Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by this Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
  2.     • "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
  5. Provide your full legal name and your electronic or physical signature.

Counter-Notification (for Users)

If you believe that your content was removed or disabled by mistake or misidentification, you may send us a Counter-Notification. When we receive a valid Counter-Notification, we will forward it to the party who submitted the original DMCA Takedown Notice. Please note that when we forward the Counter-Notification, it will include your personal contact information. By submitting a Counter-Notification, you agree that your information will be shared in this manner.

  • Identify the material that Cream Of Broccoli Soup has removed or to which Cream Of Broccoli Soup has disabled access and the location at which the material appeared before it was removed or disabled (e.g., URL).
  • Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
  • Provide your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States, for any judicial district in which Cream Of Broccoli Soup may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Provide your physical or electronic signature.
